People v. Johnson

Appellate Division of the Supreme Court of New York, First Department
Jun 27, 1996
228 A.D.2d 389 (N.Y. App. Div. 1996)

Opinion

June 27, 1996

Appeal from the Supreme Court, New York County (Howard Bell, J.).

The hearing court did not unduly limit defense counsel's cross-examination of the arresting officer concerning prior unrelated arrests. Inquiry on this issue was only marginally relevant, and the court properly exercised its discretion ( see, Delaware v. Van Arsdall, 475 U.S. 673, 679).

Concur — Milonas, J.P., Ellerin, Kupferman, Tom and Mazzarelli, JJ.
