People of Michigan v. Myron Gregory Jessie

LC No. 16-005646-01-FC

Kirsten Frank Kelly Presiding Judge, Thomas C. Cameron, Anica Letica Judges

ORDER

The motion to file a late answer is GRANTED and the answer filed on September 8, 2022 is accepted.

The delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court erred in denying the motion for relief from judgment. However, we note that the trial court, on page 4 of its July 19, 2022 opinion, indicated that defendant's claim that trial counsel should have obtained an interpreter was without merit. Defendant made no such claim in his motion for relief from judgment. Accordingly, we VACATE that part of the trial court's July 19, 2022 opinion purporting to adjudicate a claim concerning whether trial counsel should have obtained an interpreter.
