People v. Jamison

Appellate Division of the Supreme Court of New York, Second Department
Oct 10, 2000
276 A.D.2d 565 (N.Y. App. Div. 2000)

Opinion

Argued June 16, 2000

October 10, 2000.

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Marrero, J.), rendered March 10, 1998, convicting him of robbery in the second degree, robbery in the third degree, and grand larceny in the fourth degree, upon a jury verdict, and imposing sentence.

Lynn W. L. Fahey, New York, N.Y. (Debra E. Baker of counsel), for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Leonard Joblove, Thomas S. Burka, and Joseph Huttler of counsel), for respondent.

Before: ANITA R. FLORIO, J.P., DANIEL F. LUCIANO, SANDRA J. FEUERSTEIN, ROBERT W. SCHMIDT, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

Contrary to the defendant's contention, the presentence report of the codefendant, which contained a statement made by the complainant, did not constitute Brady material which should have been disclosed by the People (see, Brady v. Maryland, 373 U.S. 83; People v. Cwikla, 46 N.Y.2d 434, 44 1).

The defendant's remaining contention is without merit.
