The People of the State of New York, Respondent, v. Vijay Jain, Defendant-Appellant.
An appeal having been taken to this Court from the judgment of the Supreme Court, New York County, rendered on or about June 23, 2015, and said appeal having been perfected, And an order of a Justice of this Court having been entered on June 23, 2015 (M-2967), inter alia, admitting defendant-appellant to bail, And an order of this Court having been entered on March 1, 2016 (M-6458), inter alia, reinstating and extending a stay of execution of sentence and release on bail previously granted by an order of a Justice of this Court on June 23, 2015, and granting poor person relief and assignment of counsel, And an order of this Court having been entered on June 2, 2016 (M-1443), inter alia, continuing the stay of execution of sentence and bail granted by the order of a Justice of this Court on June 23, 2015, pending hearing and determination of the appeal, and on condition the appeal be perfected for the November 2016 Term, And an order of this Court having been entered on October 20, 2016 (M-4198), denying respondent's motion to revoke defendant's bail and for the execution of sentence stayed by the order of a Justice of this Court on June 23, 2015, And defendant-appellant having moved to exonerate bail and to execute sentence in this case, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted, and the order of a Justice of this Court, entered on June 23, 2015, is vacated, as continued by the orders of this Court entered on March 1, 2016 (M-6458), June 2, 2016 (M-1443), and October 20, 2016 (M-4198).
