Respondent having moved for an extension of the time to file and serve a brief on the appeal taken from a resentence of Ontario County Court, rendered June 1, 2011,

Now, upon reading and filing the affidavit of R. Michael Tantillo, Esq. sworn to August 1, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the Clerk is directed to accept the ten copies of Respondent's brief submitted to this Court on August 3, 2012 for filing, and

It is further ORDERED that the time to file and serve a reply brief is extended to September 4, 2012.
