PEOPLE v. JACKSON (LLOYD EARL)


Order filed

Appellant's “Second Motion for this Court to Review the Trial Court's Rulings on Record Correction; to Order the Trial Court to Comply with the Rules of Court Pertaining to Record Correction; and to Preclude the Filing of the Record on Appeal Until this Motion Is Resolved,” filed on September 20, 2021, is granted in part and denied in part as follows.

The superior court's May 28, 2021, certification of the record is vacated. The Clerk of the Supreme Court of California is directed to return the record on appeal to Superior Court of California, County of Los Angeles.

The superior court is ordered to take whatever steps are necessary to ensure that the paper version of the Reporter's Transcript provided to this court and the parties, as well as the electronic versions of the Reporter's Transcript provided to this court and the parties, include all previously ordered corrections. (Cal. Rules of Court, rule 8.622(e).)

The superior court is further ordered to take whatever steps are necessary to ensure the electronic version of the Reporter's Transcript provided to this court and the parties complies with California Rules of Court, rule 8.144, which, among other requirements, require the electronic form of the Reporter's Transcript to: (1) contain bookmarks; and (2) retain the original formatting while excluding headers, footers, line numbers, and page numbers when copying and pasting. (Cal. Rules of Court, rule 8.144(d)(1) (D) & (F).)

Appellant's motion is denied in all other respects.
