ORDER

Defendant's motion for reconsideration is DENIED. The Court on its own motion orders that the September 21, 2023 opinion is hereby AMENDED. The opinion is modified to clarify that the plea agreement included a sentence recommendation, not a sentence agreement. The opinion is amended as follows:

A footnote is added to the end of the sentence in the second full paragraph on page 2 of the original opinion which reads, "Defendant was told that this would result in the revocation of his probation and a sentence of 30 months to 15 years in prison."

The new footnote to be added to that sentence shall read as follows:

To be clear, the plea agreement included a sentence recommendation of 30 months to 15 years in prison, not a sentencing agreement. The trial court informed defendant that the recommendation would be followed. But it does not affect this Court's analysis whether this was a sentencing recommendation or a sentencing agreement.

In all other respects, the September 21, 2023 opinion remains unchanged.
