(Super. Ct. No. NA084400)
(Los Angeles County)
Tala Jackson appeals the judgment entered after he pled guilty to second degree robbery (Pen. Code, § 211). Appellant also admitted allegations that he personally used a firearm in committing the robbery (§ 12022.53, subd. (b)), and had suffered two prior strike convictions (§§ 667, subds. (b) - (i), 1170.12, subds. (a) - (d)) and two prior serious felony convictions (§ 667, subd. (a)(1)). In exchange for his plea, the trial court struck one of his prior strike convictions pursuant to section 1385 and sentenced him to 30 years in state prison. He did not obtain a certificate of probable cause.
All further undesignated statutory references are to the Penal Code.
Because appellant pled guilty prior to trial, the relevant facts are derived from the preliminary hearing transcript. Ryan Polizzi was about to get into his girlfriend's car in Torrance when appellant drove up in a red SUV. When Polizzi approached the driver's side door, appellant pointed a gun at him and said, "Give me your wallet." Polizzi complied, and appellant sped off. Polizzi called the police and reported the incident.
Less than an hour later, police officers on patrol in Wilmington began pursuing appellant's SUV after he was observed driving at an unsafe speed and failed to stop for a traffic light. Appellant ignored the police car's lights and siren and continued driving recklessly until he collided with a parked car. After appellant was arrested, several items from Polizzi's wallet (including his driver's license, military identification, and bank cards) were found in appellant's possession.
We appointed counsel to represent appellant in this appeal. After counsel's examination of the record, she filed an opening brief in which no issues were raised.
On May 17, 2011, we advised appellant that he had 30 days within which to personally submit any contentions or issues he wished us to consider. Appellant did not respond.
We have examined the entire record and are satisfied that appellate counsel has fully complied with her responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441; People v. Kelly (2006) 40 Cal.4th 106, 126.)
The appeal is dismissed.
