People v. Jackson

Court of Appeals of the State of New York
Jun 5, 1974
314 N.E.2d 875 (N.Y. 1974)

Opinion

Argued May 2, 1974

Decided June 5, 1974

Appeal from the Appellate Division of the Supreme Court in the First Judicial Department, JOHN M. MURTAGH, J.

David Bernheim for appellant.

Mario Merola, District Attorney ( Michael F. Youdovin of counsel), for respondent.

Order affirmed in the following memorandum: It may be said that certain aspects of the conduct of the defense in this case, viewed in retrospect, were probably unwise. Only questions of trial tactics were involved, however, and we conclude that defendant was not denied effective representation. We have examined defendant's other contentions and find them to be without merit.

Concur: Chief Judge BREITEL and Judges JASEN, GABRIELLI, JONES, WACHTLER and RABIN. Taking no part: Judge STEVENS.
