Appellant having moved for a writ of error coram nobis vacating the order of this Court entered July 14, 1995 affirming a judgment of Supreme Court, Erie County, rendered September 30, 1993,

Now, upon reading and filing the affidavits of Willie Ivy sworn to July 3, 2017 and August 11, 2017, the notice of motion with proof of service thereof, the affidavit of Michael J. Hillery, Esq. sworn to July 21, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
