Opinion

2007-09595.

Decided on October 4, 2011.

Appeal by the defendant from a judgment of the Supreme Court, Richmond County (Rooney, J.), rendered September 19, 2007, convicting him of murder in the second degree and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence.

ORDERED that the judgment is affirmed.

PETER B. SKELOS, J.P., THOMAS A. DICKERSON, JOHN M. LEVENTHAL, PLUMMER E. LOTT, JJ.

DECISION ORDER

The defendant's contentions raised in point one of his brief are partially unpreserved for appellate review ( see CPL 470.05). In any event, those contentions do not warrant reversal ( see People v Lewis , 48 AD3d 483 , 484; People v Wright , 40 AD3d 1021 , 1021; see also People v Singh, 299 AD2d 498, 499).

The sentence imposed was not excessive ( see People v Suitte, 90 AD2d 80).

SKELOS, J.P., DICKERSON, LEVENTHAL and LOTT, JJ., concur.
