The People of the State of New York, Respondent, v. Ind. Nos. 3177/15 1875/16 Tuaron Smith, 3802/16 Defendant-Appellant.


An order of this Court having been entered on May 10, 2018 (M-1593), inter alia, granting defendant's motion for leave to prosecute, as a poor person, the appeal from a judgment of the Supreme Court, Bronx County, rendered on or about June 1, 2017, under Indictment Nos. 3802/16, 1875/16 and 3177/15, and assigning counsel therefor, and the appeal having been perfected, (Calendared for the September 2019 Term, Cal. No. 3804) And defendant-appellant having moved for an order amending the notice of appeal and the aforementioned order to include the correct judgment date of September 21, 2017 when appellant was resentenced under Bronx Co. Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted.
