    The jury convicted the defendant of depraved indifference murder and criminal possession of a controlled substance in the seventh degree. This Court affirmed the judgment of conviction by decision and order dated October 4, 2004 (seePeople v. Illis, 11 A.D.3d 481, 782 N.Y.S.2d 374 ). Thereafter, by notice of motion dated October 21, 2004, the defendant moved for leave to reargue the appeal.
