THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. DANNY HURST, DEFENDANT-APPELLANT.

Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Livingston County Court, rendered December 1, 2009, and for other relief,

Now, upon reading and filing the affidavit of Matthew F. Schwartz, Esq. sworn to February 13, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered January 14, 2013 is hereby amended by striking therefrom the date April 15, 2013 and inserting in place thereof the date June 14, 2013, and

It is further ORDERED that the motion is otherwise denied.
