The People of the State of New York, Respondent, v. Lamont Hunnighen, Defendant-Appellant.


Defendant-appellant having moved to deem the notice of motion a timely filed notice of appeal taken from a judgment of the Supreme Court, Bronx County, rendered on or about June 26, 2019, or, in the alternative, for leave to file a late notice of appeal, and for leave to prosecute the appeal, as a poor person and assigning Janet E. Sabel, Esq., The Legal Aid Society, as assigned counsel, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of deeming the moving papers a timely filed notice of appeal. The motion is otherwise denied, with leave to renew, upon defendant's submission of a detailed, notarized affidavit in compliance with CPLR 1101(a),and 22 NYCRR 1250.4(d)(i) and (4), setting forth his indigency and the amount and sources of his income, as well as a listing of his property with its value.
