DECISION AND ORDER ON MOTION (Ind. No. 45-2017)

Motion for permission to proceed on appeal as a poor person and for assignment of counsel.

Upon the papers filed in support of the motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is granted only to the extent that counsel is assigned for the purpose of moving for an enlargement of time pursuant to section 850.11 (d), of this Court's Rules of Practice and responding to the motion by the People to dismiss the appeal, and it is further

ORDERED that Erin C. Morigerato, Esq., P.O. Box 7297, Capitol Station, Albany, NY 12224, 518-331-1673, is assigned to represent appellant for that purpose, pursuant to County Law § 722.
