People v. Hudgins

Supreme Court of Michigan
Apr 1, 2003
468 Mich. 880 (Mich. 2003)

Opinion

No. 121817.

April 1, 2003.

COA: 241396, Wayne CC: 94-003618

On order of the Court, the application for leave to appeal from the June 5, 2002 decision of the Court of Appeals is considered, and it is DENIED because the defendant's motion for relief from judgment is prohibited by MCR 6.502(G), and he has failed to demonstrate an exception to that rule.

Cavanagh and Kelly, JJ., would remand this case to the Wayne Circuit Court to consider whether defendant's motion for relief from judgment is based on a claim of new evidence that was not discovered before the first such motion. MCR 6.502(G)(2).
