On order of the Court, the delayed application for leave to appeal from the July 17, 2001 decision of the Court of Appeals, and the motions to remand and for immediate consideration are considered. The motion for immediate consideration is GRANTED. The delayed application for leave to appeal and the motion to remand are DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D).
