PRESENT:

Respondent having moved to reschedule oral argument for the appeal taken from a judgment of Niagara County Court, rendered July 30, 2014,

Now, upon reading and filing the affidavit of Thomas H. Brandt, Esq. sworn to May 25, 2016, the notice of motion with proof of service thereof, the statement of Robert M. Graff, Esq. filed June 6, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the appeal is removed from the day calendar for September 16, 2016, and

It is further ORDERED that the appeal shall be added to the day calendar for September 8, 2016.
