Decided January 7, 2005.

Defendant appeals from a judgment of the Criminal Court, New York County, rendered May 22, 2003 (Judith A. Levitt, J.) convicting him, upon a plea of guilty, of menacing in the second degree (Penal Law § 120.14), and imposing sentence.
