PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgments of the Onondaga County Court, rendered September 4, 2014,

Now, upon reading and filing the affidavit of John Homer sworn to May 25, 2015, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal filed in the Onondaga County Clerk's Office on March 4, 2015 and served upon the Onondaga County District Attorney on February 9, 2015 is hereby deemed timely filed and served, and

It is further ORDERED that said pro se notice of appeal shall be treated as valid as to the judgment rendered under Indictment Nos. 2014-0668-1 and 2013-1206-1, pursuant to CPL 460.10(6).
