ORDER

On reconsideration pursuant to the December 9, 2022 order of the Michigan Supreme Court, we VACATE the part of the January 16, 2020 order of this Court that dismissed the delayed application for leave to appeal.

The delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court committed an error requiring reversal in denying the motion for relief from judgment. See People v Powell, 303 Mich.App. 271, 279 n 1; 842 N.W.2d 538 (2013).

Hood, J., would deny the delayed application for leave to appeal because we are bound by People v Adamowicz (On Second Remand), ___ Mich.App. ___, ___; ___ N.W.2d ___ (2023) (Docket No. 330612).
