DECISION & ORDER ON MOTION

Appeal by the defendant from a sentence of the County Court, Orange County, imposed May 21, 2012. By order to show cause dated April 24, 2013, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal had been rendered academic as the appellant had been released from incarceration.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed.

RIVERA, J.P., DILLON, DICKERSON and AUSTIN, JJ., concur.
