Oct 22, 2001
287 A.D.2d 651 (N.Y. App. Div. 2001)

Opinion

Submitted September 28, 2001.

October 22, 2001.

Appeal by the defendant from a judgment of the Supreme Court, Richmond County (Rooney, J.), rendered March 9, 2000, convicting him of criminal mischief in the fourth degree, upon a jury verdict, and imposing sentence.

Lynn W. L. Fahey, New York, N.Y. (Denise A. Corsi of counsel), for appellant.

William L. Murphy, District Attorney, Staten Island, N.Y. (Karen F. McGee of counsel; Kelly Barnard on the brief), for respondent.

Before: CORNELIUS J. O'BRIEN, J.P., DANIEL F. LUCIANO, ROBERT W. SCHMIDT, THOMAS A. ADAMS, JJ.

ORDERED that the judgment is affirmed.

Contrary to the defendant's contention, the court's Sandoval ruling properly balanced the relevant considerations (see, People v. Sandoval, 34 N.Y.2d 371; People v. Reyes, 193 A.D.2d 767; People v. Vanderhall, 168 A.D.2d 655, 656).

O'BRIEN, J.P., LUCIANO, SCHMIDT and ADAMS, JJ., concur.
