Defendant having moved for a writ of error coram nobis seeking leave to file a late notice of appeal from a judgment of Onondaga County Court rendered August 17, 1990,

Now, upon reading and filing the affidavit of Teddy Hill, sworn to May 9, 2013, the notice of motion with proof of service thereof, the statement of John F. Laidlaw, Esq., dated May 21, 2013, and due deliberation having been had thereon,
