THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. AVIS HILL, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved, pursuant to CPL 450.10 (1) and 460.30, for an extension of time to file a notice of appeal from an order of the County Court, Ontario County, dated January 31, 2020,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied on the ground that here the time to take an appeal is governed by CPLR 5513, and an extension is not available under CPL 460.30 (see Matter of Hynes v Karassik, 47 NY2d 659, 661 n 1 [1979]).
