People v. Hess

Supreme Court of Illinois
Aug 20, 2002
202 Ill. 2d 633 (Ill. 2002)

Opinion

No. 94820.

August 20, 2002. November 2002.

Appeal from Summary Order No. 2-01-0334.

Leave to appeal denied with order.

In the exercise of this court's supervisory authority, the cause is remanded to the circuit court of Du Page County. The circuit court is directed to consider the third issue in the petition for leave to appeal — whether trial or appellate counsel were constitutionally ineffective for failing to challenge the validity of the guilty plea in circumstances substantially identical to those presented in People v. Belcher, 199 Ill. 2d 378 (2002) — as a post-conviction petition.
