An appeal having been taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about May 18, 2023, And an order of this Court, entered on October 19, 2023, having denied, with leave to renew, defendant's motion to relieve Caprice R. Jenerson, Esq., The Office of the Appellate Defender, as counsel to prosecute the aforesaid appeal (Motion No. 2023-04175; Case No. 2023-02625), And defendant-appellant having moved for "reargument" of the aforesaid order of this Court, and for an order substituting Lawrence LaBrew, Esq., as appellate counsel, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of striking the designation of Caprice R. Jenerson, Esq., The Office of the Appellate Defender, as assigned counsel to prosecute defendant's appeal; the motion is otherwise denied as unnecessary.
