An order of this Court having been entered on August 03, 2023 (Motion No. 2023-02815) granting defendant leave to prosecute, as a poor person, the appeal from a judgment of the Supreme Court, New York County, rendered on or about May 18, 2023, and assigning Caprice R. Jenerson, Esq., the Office of the Appellate Defender, as counsel to prosecute the appeal; and defendant having moved to relieve such counsel, and for related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon proof of defendant's consent to substitute counsel.
