(Super. Ct. No. 2010042008)
(Ventura County)
Alejandro Hernandez appeals from his conviction by jury of second degree robbery. (Pen. Code, § 211) The trial court sentenced him to the midterm of three years in state prison.
The victim was employed by a company that purchased gold. On November 8, 2010, appellant contacted the business, and the victim's employer instructed the victim to meet with appellant. She drove to his residence and he met her on the sidewalk. Appellant gave the victim several items. She examined them which she returned, saying they were not gold. Appellant then got in her car, pulled out something that looked like a gun and demanded money. The victim gave him $3,000.
We appointed counsel to represent appellant in this appeal. After examining the record, counsel filed an opening brief raising no issues and requesting that this court independently examine the record pursuant to People v. Wende (1979) 25 Cal.3d 436.
On September 7, 2011, we advised appellant that he had 30 days within which to personally submit any contentions or issues he wished to raise on appeal. We have received no response from him.
We have reviewed the entire record and are satisfied that appellant's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Kelly (2006) 40 Cal.4th 106, 124; People v. Wende, supra, 25 Cal.3d at p. 441.)
