The Michigan Supreme Court vacated as unnecessary the portion of the Court of Appeals judgment relating to the warrantless search, since the weight and strength of the untainted evidence presented at trial precluded the defendant from demonstrating a reasonable probability that, even if trial counsel had filed a motion to suppress, the result of the proceeding would have been different. See People v. Henix, 491 Mich. 939 (2012). Petitioner then filed the pending petition.
