Opinion

Attorney Regulation.

The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Respondent Thomas J. Helms (Attorney Registration No. 11762) from the practice of law for a period of one year and one day; all but sixty days stayed upon the successful completion of a two-year period of probation, with conditions, effective September 2, 2006. Respondent filed a medical malpractice lawsuit on behalf of his clients, but the court dismissed the case after Respondent failed to set it for trial. He continued to work on the case and represent to his clients that everything was moving along fine for the next three years. Respondent's misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.3, 1.4(a), and 8.4(c).
