The PEOPLE of the State of New York, Respondent, v. Chad E. HEIDEMAN, Defendant–Appellant.

Appeal from a judgment of the Orleans County Court (James P. Punch, J.), rendered July 12, 2010. The judgment convicted defendant, upon his plea of guilty, of assault in the second degree.Shirley A. Gorman, Brockport, for defendant-appellant. Joseph V. Cardone, District Attorney, Albion (Katherine Bogan of Counsel), for respondent.

It is hereby ORDERED that the judgment so appealed from is unanimously affirmed ( see People v. Hidalgo, 91 N.Y.2d 733, 737, 675 N.Y.S.2d 327, 698 N.E.2d 46).
