ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

King, J.

The petition for rehearing is denied. The opinion filed in this matter on April 18, 2008, is modified as follows:

The first full sentence on page 3 of the opinion reading, “We agree that section 654 barred imposition of sentence on both counts 2 and 3[]” shall be deleted. It shall be replaced with the following sentence:

“We agree that section 654 barred imposition of sentence on count 2.”

Except for this modification, the opinion remains unchanged. This modification does not affect a change in the judgment.
