ORDER MODIFYING OPINION
[NO CHANGE IN JUDGMENT]
THE COURT:
It is ordered that the opinion filed herein on December 28, 2011, be modified as follows:
1. On page 2, footnote 1 is deleted and the following footnote 1 is inserted in its place:
[Fn. 1] All further statutory references are to the Penal Code unless otherwise indicated.
Counts 2 and 6, also charging robberies, were dismissed; count 2 pursuant to appellant's section 995 motion, and, later, count 6 pursuant to his section 1118.1 motion. The counts were thereafter renumbered for trial and the verdict forms, counts 3 through 5 of the information became counts 2 through 4. We hereafter refer to these counts by their original designation as counts 3 through 5.
2. On page 2, the subheading "September 14, 2008 (count 2)" is deleted and the following subheading is inserted in its place:
September 14, 2008 (count 3)
3. On page 3, the subheading "October 21, 2008 robbery (count 3)" is deleted and the following subheading is inserted in its place:
October 21, 2008 robbery (count 4)
4. On page 3, the subheading "January 8, 2009 robbery (count 4)" is deleted and the following subheading is inserted in its place:
January 8, 2009 robbery (count 5)
5. On page 4, the last full paragraph, the second sentence, beginning "He argues" is deleted and the following sentence is inserted in its place:
He argues that as a result, appellant's conviction of count 3, the September 14, 2008 robbery, was based exclusively on inadmissible hearsay.
There is no change in the judgment.
