THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. MUZZAMMIL S. HASSAN, ALSO KNOWN AS MO HASSAN, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for the reassignment of counsel on the appeal taken from the judgment of Erie County Court, rendered March 9, 2011,

Now, upon reading and filing the affidavit of Mo S. Hassan sworn to December 23, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the dismissal of the appeal is vacated on the condition that the appeal is perfected on or before April 20, 2017, and

It is further ORDERED that Michael J. Stachowski, Esq. is relieved of his assignment, and

It is further ORDERED that the request for reassignment of counsel to prosecute the appeal taken from the judgment of Erie County Court, rendered March 9, 2011 is granted to the extent that the Erie County Assigned Counsel Administrator is directed to provide this Court with an attorney who is willing and able to accept this assignment.
