PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Erie County Court, rendered March 9, 2011, and for other relief,

Now, upon reading and filing the affirmation of Kevin J. Bauer, Esq. dated April 11, 2013, the notice of motion with proof of service thereof, the statement of Donna A. Milling, Esq. dated April 16, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion in sofar as it seeks an extension of time to perfect said appeal is granted to the extent that the ordering paragraph of the order of this Court entered October 16, 2012 is hereby amended by striking therefrom the date April 15, 2013 and inserting in place thereof the date September 16, 2013.

It is further ORDERED that the motion is otherwise denied without prejudice.

Memorandum: Counsel has failed to provide sufficient facts to warrant granting permission to file a brief in excess of 70 pages.
