Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and, upon reargument, the decision and order of this court dated September 8, 2023 (81 Misc.3d 127[A], 2023 NY Slip Op 51229[U]) is recalled and vacated, and a new decision and order substituted therefor (see appeal No. 2021-740 Q CR, decided simultaneously herewith).
