THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. SHIRLON HARRIS, DEFENDANT-APPELLANT.


PRESENT:

Respondent having moved to dismiss the appeal taken from an order of the Orleans County Court, dated September 8, 2016, on the ground that appellant has failed to perfect timely the appeal,

Now, upon reading and filing the affirmation of Joseph V. Cardone, Esq. dated August 1, 2017, the notice of motion with proof of service thereof, the statement of Shirlon Harris dated August 11, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed.

Memorandum: This Court is not the proper venue for any further review of the order of Orleans County Court dated September 8, 2016 affirming the judgment of a local criminal court (see CPL 450.60 [3]; 450.90 [1]).
