THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ROY D. HARRIGER, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for the substitution of counsel on an appeal taken from a judgment of Orleans County Court, rendered April 6, 2015,

Now, upon reading and filing the affidavit of J. Glenn Davis, Esq. sworn to December 7, 2015, the notice of motion with proof of due service thereof, the notice of motion to withdraw and substitute counsel dated September 29, 2015 signed by Roy D. Harriger, J. Glenn Davis, Esq. and Timothy P. Murphy, Esq., and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the order of this Court entered May 20, 2015 is vacated, and

It is hereby further ORDERED that appellant perfect the appeal pursuant to 22 NYCRR 1000.3 (b).
