Opinion

No. 124773.

December 11, 2003. March 30, 2004.

Summary Disposition.

No. 124773. In lieu of granting leave to appeal, the June 5, 2003, judgment of the Court of Appeals is reversed and the case is remanded for consideration of the issues raised by defendant that were not reached by the Court of Appeals. Defendant has not demonstrated a reasonable probability that, but for his trial counsel's failure to perfect an alibi defense, the result of the proceeding would have been different. People v. Toma, 462 Mich 281, 302-303 (2000). MCR 7.302(G)(1). Court of Appeals No. 230717.
