Appellate Division of the Supreme Court of New York, Second Department
Aug 22, 2005
21 A.D.3d 567 (N.Y. App. Div. 2005)

Opinion

2003-08452.

August 22, 2005.

Appeal by the defendant from a judgment of the County Court, Westchester County (Zambelli, J.), rendered August 19, 2003, convicting him of sexual abuse in the first degree, upon his plea of guilty, and imposing sentence.

Thomas T. Keating, White Plains, N.Y., for appellant.

Jeanine Pirro, District Attorney, White Plains, N.Y. (Valerie A. Livingston of counsel; Michael J. Ashraf on the brief), for respondent.

Before: Florio, J.P., Krausman, Crane, Rivera and Fisher, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
