Opinion

No. 119018.

05-27-2015

PEOPLE State of Illinois, respondent, v. Charles K. HAMILTON, petitioner.

Opinion

Petition for leave to appeal denied.

In the exercise of this Court's supervisory authority, and in the effort to ensure that justice is dispensed and without any implication to the appellate court analysis, the Appellate Court, Fourth District, is directed to vacate its judgment in People v. Charles K. Hamilton, case No. 4–13–0612, 2015 WL 708544 (02/17/15). The appellate court is directed to remand the matter to the Circuit Court of McLean County solely for a factual determination of whether the 1990 DeKalb County, Georgia conviction, at issue at defendant's April 30, 2013, sentencing hearing, is attributable to defendant, and if not, whether the twenty-two year sentence (plus credit for time served) previously imposed remains the appropriate sentence for defendant, or whether another sentence should be imposed. The circuit court shall again admonish defendant in accordance with Rule 605; however, only sentencing issues arising on remand may be the subject of a further appeal.
