PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. STEVEN DARYL HAMIEL, a/k/a ROLAND SMITH HARRENT, Defendant-Appellant.

Washtenaw CC: 15-000595-FH

Elizabeth T. Clement, Chief Justice Brian K. Zahra David F. Viviano Richard H. Bernstein Megan K. Cavanagh Elizabeth M. Welch Kyra H. Bolden, Justices

ORDER

On order of the Court, the application for leave to appeal the November 17, 2022 judgment of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court.

BOLDEN, J. (concurring).

I agree with the majority's decision to deny leave to appeal in this case. Defendant has not demonstrated entitlement to the transcripts he is seeking and there is no error in denying this motion. If, however, defendant wishes to continue pursuit of these transcripts, it may increase his chances of success in obtaining them if he files a more particularized motion. For example, defendant could provide the trial court with information regarding the exact transcripts he is seeking, the postconviction relief for which he intends to use the transcripts to provide support, and an explanation of how the transcripts will further his chances of obtaining that relief.
