People v. Hall

Appellate Division of the Supreme Court of New York, Second Department
Nov 13, 2007
45 A.D.3d 698 (N.Y. App. Div. 2007)

Opinion

No. 2006-08189.

November 13, 2007.

Appeal by the defendant from an amended judgment of the County Court, Orange County (DeRosa, J.), rendered August 8, 2006, revoking a sentence of probation previously imposed by the same court, finding that he violated a condition thereof, upon his admission, and imposing a sentence of imprisonment upon his previous conviction of operating a motor vehicle while under the influence of alcohol.

Arza Feldman, Uniondale, N.Y. (Feldman and Feldman [Steven A. Feldman] of counsel), for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (David R. Huey of counsel), for respondent.

Before: Schmidt, J.P., Spolzino, Skelos, Lifson and McCarthy, JJ., concur.

Ordered that the amended judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631 [1976]; cf. People v Gonzalez, 47 NY2d 606).
