MOTION DECISION

An order of this Court having been entered on July 23, 2020 (M-1756), inter alia, granting defendant's motion for leave to prosecute, as a poor person, the appeal from a judgment of the Supreme Court, Bronx County, rendered on or about January 29, 2020, and assigning counsel therefor, And defendant-appellant having moved, pursuant to CPL 460.10(6) to deem the instant notice of motion a timely filed notice of appeal, or in the alternative, for permission to extend the time to file a notice of appeal from a judgment of resentence, same court and Justice, rendered on or about May 19, 2021 and for an order amending the notice of appeal and the aforementioned order to include the aforesaid judgment of resentence, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that said motion is granted to the extent of amending defendant's notice of appeal and the aforementioned order of this Court to include the aforesaid judgment of resentence and extending the poor person relief previously granted to cover same.
