The motions for immediate consideration are GRANTED.
The motion to waive the transcript production requirement of MCR 7.209(A)(3) regarding the motion to stay proceedings is GRANTED.
Pursuant to MCR 7.205(E)(2), the Court orders that the Court Reporter produce the August 16, 2021, August 17, 2021, and August 18, 2021, transcripts that the prosecution ordered on August 19, 2021, within fourteen (14) business days of the Clerk's certification of this order. Assistant Prosecuting Attorney Matthew A. Fillmore is directed to file a copy of the transcripts with this Court, and serve a copy on defense counsel Andrew Mikos, immediately upon receipt. Mr. Fillmore shall also transmit a copy of this order to Sandra Trakos of Accurate Transcription Services immediately upon receipt of this order.
Defense counsel is directed to file an answer to the application for leave to appeal within seven (7) days after receipt of the transcripts.
The application for leave to appeal is HELD IN ABEYANCE pending receipt of the transcripts and the answer to the application.
The motion for stay pending appeal is GRANTED. Further proceedings are STAYED pending resolution of this appeal or further order of this Court.
