ORDER MODIFYING OPINION NO CHANGE IN THE JUDGMENT
THE COURT:
It is ordered that the opinion filed herein on November 9, 2011, be modified as follows:
1. On page 2, line 17, the word "switch blade" is changed to "switchblade" so that the sentence reads:
Defendant was carrying two knives, a switchblade in his jacket and a pocket knife in his pants.
2. On page 3, line 11, delete the comma after the word "and" and before the word "the" so that the sentence reads:
In the first case, the court imposed, but suspended the execution of, a sentence of three years, including a one-year prison prior enhancement; and the court required defendant to serve 289 days in jail as a condition of probation, awarding him credit of 289 days, consisting of 193 actual days plus 96 for good conduct.
3. On page 3, in the second sentence of the fourth full paragraph the words "seat" and "passenger" are transposed. The sentence should read:
A bag of marijuana was found in the front passenger seat where defendant was sitting.
4. On page 15, line 19 section "2933"is changed to section"2933.3" so that the sentence reads:
Thus, section 2933.3, subdivision (d), which took effect on January 25, 2010, was made retroactively applicable to inmates eligible after July 1, 2009.
There is no change in the judgment.
