THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ANGEL GUZMAN, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for an extension of time to perfect the appeals taken from the judgments of Wayne County Court, rendered January 26, 2012, and respondent having cross-moved to dismiss the appeals on the ground that appellant has failed to perfect timely,

Now, upon reading and filing the affirmation of David M. Abbatoy, Jr., Esq. dated December 28, 2015, the notice of motion with proof of service thereof, the affirmation of Bruce A. Rosekrans, Esq. dated December 30, 2015, the notice of cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion of appellant is granted on the condition that appellant perfect the appeals on or before March 21, 2016, and in the event of failure to so perfect, the appeals are hereby dismissed without further order, and

It is further ORDERED that the cross motion is denied.
