DECISION & ORDER ON MOTION

Motion by the respondent on appeals from three judgments of the County Court, Suffolk County, all rendered June 4, 2008, to dismiss the appeal from the judgment under Indictment No. 3077/08 for failure to timely perfect.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the appeal from the judgment under Indictment No. 3077/08 (Appellate Division Docket No. 2008-03036) is dismissed (see 22 NYCRR 670.8[f]; CPL 470.60[1]).
